Israel claims the ICC does not have jurisdiction to try Netanyahu for the crime of starving Palestinians

The International Criminal Court (ICC) chief prosecutor asked the court's judges to reject Israeli objections to a warrant issued for the arrest of Israeli Prime Minister Benjamin Netanyahu and former defense minister Yoav Gallant for war crimes in Gaza.

Karim Khan submitted his 55-page response to Israel's objection on 13 January.

The ICC arrest warrants accuse Netanyahu and Gallant of committing war crimes against Palestinians, including using starvation as a weapon in Gaza.

Israel has argued that the ICC does not have jurisdiction to try the Israeli leaders because they could theoretically be tried in an Israeli court.

Khan asserted that the court had jurisdiction over all states party to the Rome Statute, regardless of where the perpetrators were from.

Palestine, Ukraine, Canada, and all countries of the EU accept the statute, Khan said, while dozens of countries do not accept the court's jurisdiction, including Israel, the US, Russia, and China.  (more...)
